Terms of auction


The auction takes place voluntarily, in the name and for the account of the consignors.


The wines are auctioned in the condition they are in at the moment of the knockdown. The description is given to the best of our knowledge and belief. However, it does not represent guaranteed characteristics within the meaning of § 459 ff. BGB (German Civil Code).


The auctioneer shall have the right to combine, separate or withdraw lots of the catalogue or to auction them out of sequence.


The bidding shall commence at the lower minimum bid price stated in the catalogue. The auction jumps are to be taken from the "notes of running the auction".


The knockdown shall be made to the highest bidder at the end of the auction, whereby this can only take place at the bidding increments specified by Koppe & Partner Weinauktionen GbR. In the event of bids of the same amount being received for a particular lot, the time of online bidding shall be decisive.


The acceptance of a bid obliges the buyer to take delivery. Ownership shall not pass to the bidder until the purchase price has been paid, and the risk of any damage shall pass to the bidder upon acceptance of the bid.


By placing an online bid, the bidder accepts our auction conditions. Each bidder is personally liable for his purchases on the basis of his registration and cannot claim to have acted on behalf of third parties.


In addition to the hammer price, the bidder must pay a uniform buyer's premium of 10%. In addition, a handling fee of EUR 5.00 will be charged per increased lot. The buyer's premium and the lot fee are subject to VAT. The hammer price, however, is not subject to VAT.


Payments are due in full: before the auctioned lots are handed over, at the latest 8 days after the end of the auction, to the account stated on the invoice. If the payment is not made or not made in time, the auctioneer may choose to demand fulfilment of the purchase contract and, irrespective of this, to auction the lots again at the expense of the successful bidder. In this case the buyer is liable for the loss and his rights from the previous knockdown expire. The successful bidder shall not be entitled to any additional proceeds. He will not be admitted to a further bid. In the event of late payment, interest shall be charged at the rate of 1% per month or part thereof. Exchange losses and redemption fees shall be borne by the bidder. Even without a reminder, the bidder is liable for any damage in the event of late payment or refusal to accept an awarded lot. The Auctioneer may collect/claim purchase money, arrears and ancillary services in his own name.


Lots may only be accepted after payment has been made in full. For lots which have not been collected at the latest 4 weeks after the auction date or which have not been dispatched at the request of the highest bidder, a storage fee of 5% of the hammer price will be charged for each calendar month or part thereof. Delivery of the wines shall be made by DHL or specialist forwarding agent. The freight costs are to be borne by the buyer. The transport costs in Germany amount to EUR 1.50 per 0.75 l bottle (other EU-countries: EUR 2.50), but at least EUR 15.00 (other EU-countries: EUR 25.00) plus VAT. Delivery to countries outside the EU is not possible, but self-organised collection is. The Auction House shall not assume any liability for any damage or loss.


Place of performance and exclusive place of jurisdiction is the Auctioneer's registered office. The legal relationship according to German law shall be deemed agreed.


Koppe & Partner Weinauktionen GbR does not assume any liability for the loss and incorrect transmission of data. The user shall bear the full risk for any damage and/or consequential damage of whatever kind caused by the operation or non-functioning of the software.
